Terms of Service and End User Licence Agreement

1. Acceptance of Terms
By downloading, installing, or using Kanazawa Go, you agree to be bound
by these Terms of Service and our Privacy Policy. If you do not agree to
these terms, you must not use the app and should delete it from your
device immediately.

3. Scope of Licence (EULA)
CramBerry grants you a personal, non-exclusive, non-transferable,
revocable licence to use Kanazawa Go on your personal devices.

Platform Acknowledgement: You acknowledge that this
agreement is between you and CramBerry only, and not with Apple Inc.
or Google LLC. CramBerry is solely responsible for the app and its
content.

Maintenance: CramBerry is solely responsible for
providing any maintenance and support services for the app.
4. Proprietary Content and Intellectual Property
This app contains original curated content that is the result of
significant creative and financial investment.

Ownership: All text, original photography, audio
voiceovers, bespoke map layouts, and curated routes are the exclusive
property of CramBerry.

Copyright Protection: This content is protected by
United Kingdom and international copyright laws. Your licence is for
listening and viewing only.

No Extraction: You are strictly prohibited from
recording, extracting, "ripping," or redistributing the audio
voiceovers or photography from the app for use in any other medium or
for any other purpose.
5. Restrictions
You may not:

Copy, modify, or create derivative works of the app or its content.

Reverse engineer, decompile, or attempt to extract the source code.

Use any automated system or software to scrape or harvest data, text,
or images.
- Use the app's content to build a competing product or service.

Use the content for any commercial purpose without a separate
commercial licence from CramBerry.
6. Offline Content
Users may download specific content for offline use within the app.
These files remain the property of CramBerry and are subject to the same
protections and restrictions as online content.
7. User Accounts
You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- Ensuring your account information is accurate.

Account Deletion: You may delete your account at any
time using the in-app account deletion feature or by contacting
CramBerry.
8. Disclaimers: Accuracy, Safety, and Satisfaction
Kanazawa Go is provided on an "AS IS" and "AS AVAILABLE" basis.

Information Accuracy: While we strive for accuracy,
we do not guarantee the timeliness or correctness of third-party
information, including but not limited to business opening hours,
entry prices, or transit schedules.

Physical Safety: Users explore Kanazawa at their own
risk. CramBerry is not liable for any injury, accident, loss of
property, or damage sustained while following suggested routes or
visiting recommended locations.

Subjective Experience: Travel is personal and
subjective. CramBerry is not responsible if you have an unsatisfactory
experience at a recommended location, or if you do not like the app
content, voiceover style, or recommendations. No refunds will be
issued based on personal preference or subjective dissatisfaction.

Local Compliance: Always follow local Japanese laws,
posted signage, and instructions from temple or shrine staff.

Kanazawa Go may include links to third-party websites or services.
CramBerry does not control and is not responsible for the content,
policies, or practices of any third-party sites.
10. Termination, Discontinuation, and Refunds

Termination: We may suspend or terminate your access
if you violate these Terms.

Right to Discontinue: CramBerry reserves the right to
modify, suspend, or permanently discontinue the app or any part of the
service at any time.

No Refunds: All purchases are final. In the event
that the app is discontinued or removed from stores, or if you choose
to stop using the service, no refunds will be provided.
11. Limitation of Liability
To the maximum extent permitted by law, CramBerry's total liability for
any claim arising out of the use of the app shall not exceed the amount
you paid, if any, to CramBerry for the app.
12. Indemnification
You agree to indemnify and hold harmless CramBerry from any claims,
damages, losses, liabilities, and expenses arising out of your misuse of
the app or violation of these Terms.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of Kanazawa
Go after changes become effective constitutes acceptance of the revised
Terms.
14. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes
shall be subject to the exclusive jurisdiction of the courts of England
and Wales.
